GTC
1.General
1.1.
These General Terms and Conditions apply to e-ticket contracts concluded with Attraktion! Projects GmbH (FN 322289 f), Habsburgergasse 10a, 1010 Vienna (hereinafter also referred to as "The Operator") with end consumers (hereinafter also referred to as "Customers") via the Internet platform immersium.com.
1.2.
The operator provides an online platform through which customers can obtain information about the operator's business purpose and purchase admission tickets to the adventure world online. Single or multiple e-tickets can be purchased during the ordering process. In this case, the following provisions apply mutatis mutandis to all e-tickets.
A valid e-mail address is required to purchase an e-ticket.
The order is considered binding once the purchase process has been successfully completed.
1.3.
The contract for the purchase of an e-ticket is concluded directly between the customer and the operator.
1.4.
Customers have the option of correcting/changing the data entered again in the ticket store process (under "Check your details"). By clicking on the "Confirm" button, the customer submits an offer to the operator to conclude an e-ticket contract. The operator accepts such an offer by sending a confirmation email to which a PDF for the printable e-ticket is attached. This concludes the e-ticket contract. The e-ticket is handed over to the customer by sending the confirmation email from the operator. The customer has the option of printing out the e-ticket using the attached PDF or saving it on their smartphone. E-tickets can also be printed or saved from the Internet browser at the end of the respective order process.
1.5.
The e-ticket is only valid for the specified performance date (day, time, number of people). If the customer does not appear on the agreed date, the validity expires. A postponement is possible after conclusion of the contract, but must be announced 24 hours in advance.
1.6.
These General Terms and Conditions are made available to the customer via a separate link or as a PDF download immediately before the declaration "I have read and agree to the GTC" prior to the conclusion of the contract.
By clicking on the declaration "I have read and agree to the General Terms and Conditions", the customer acknowledges his agreement with the application of these General Terms and Conditions.
2.Payment
2.1.
Payment is made by the means of payment offered during the purchase process (credit cards, instant bank transfer, Paypal)
Other payment methods are not possible until further notice.
To ensure data security, data integrity and data transmission, the purchase transactions are SSL-secured and subsequently processed by the company. Convious (https://www.convious.com/).
2.2.
If a payment is charged back before the start of the tour, the e-ticket will be declared invalid.
3.Prices
3.1.
All prices listed in the e-ticket system are euro prices incl. VAT. the statutory value added tax applicable in Austria.
3.2.
If reduced prices are claimed, for example for children's tickets, proof of claiming the discount must be provided before the start of the performance.
Discounted children's tickets can be purchased when buying tickets. Children are defined as persons up to the age of 14. The discount is printed on the e-ticket and checked directly at the entrance before the performance begins.
4. Defaults and liability
4.1.
The operator reserves the right to block individual stations on a case-by-case basis (maximum 1 day per station and year) for maintenance and repair purposes.
5.Data protection
5.1.
The operator uses a secure transmission method (SSL) for the transfer of customer data. In this way, the operator attempts to achieve the highest possible safety standard. Nevertheless, the operator cannot accept any responsibility for attacks by hackers and the like.
5.2.
The protection of the personal data of our interested parties, customers, partners and employees is of particular concern to us. We therefore process this data exclusively on the basis of the applicable legal provisions (EU GDPR, DSG 2018, TKG 2003).
6.Website use
6.1.
The operator provides the customer and interested parties with an online platform via which they can obtain information on the operator's business purpose.
6.2.
The operator is not responsible for websites to which there are links from the operator's website.
6.3.
Despite careful maintenance of its website, the operator cannot guarantee that the operation of its website is free from errors and interruptions.
The operator is also not liable for ensuring that it is possible to order e-tickets via the website at any time. The operator is entitled to take the website temporarily offline or otherwise restrict its services if this is necessary for reasons of security or for the purpose of carrying out technical measures (in particular maintenance work).
The operator is only liable for at least grossly negligent behavior.
7 Other provisions
7.1.
The invalidity of individual provisions of these General Terms and Conditions shall not affect the validity of all other provisions.
7.2.
Written declarations (in particular the confirmation e-mail of the e-ticket) are sent by e-mail.
7.3.
This contractual relationship shall be governed by Austrian law. The competent court in Vienna is agreed as the place of jurisdiction, unless mandatory statutory provisions stipulate a different place of jurisdiction.
